General Terms and Conditions
1.1 The objectives of Asate AG are to offer private people - hereinafter referred to as “participants“ - the opportunity of taking part in a - standard or online - therapy seminar intended to cure snoring and the obstructive sleep apnoea syndrome and/or the possibility of ordering the Asate plexiglass instrument with playing instructions against snoring, hereinafter referred to as “self-training“.
1.2 After the fully completed therapy seminar or after ordering the instrument including playing instructions, Asate AG offers the option of using various additional offerings provided by Asate AG.
1.3 These General Terms and Conditions shall apply to all parties.
2.1 The present General Terms and Conditions apply to the entire offering of Asate AG, to all visitors of asate.ch and to all people who register for a therapy seminar (standard, online, additional offerings) or who order instructions for self-training.
The General Terms and Conditions are based on Swiss law and are applicable in Switzerland and abroad. Changes or supplements are only effective if agreed by both parties.
2.3 If a provision of these General Terms and Conditions is or becomes invalid or if they contain a gap, the validity of the other provisions shall not be affected. The void or invalid provision shall be replaced by a provision, which comes as close as possible to the purpose of the invalid provision.
3.1.1 Asate AG offers potential participants the opportunity of registering for a standard seminar selected by them, hereinafter referred to as “therapy seminar”.
3.1.2 Standard therapy seminars are divided into 2 parts each of 3 hours, both seminar parts taking place normally at the same place and the same date.
For organisational and therapeutic reasons, the registration applies automatically to both seminar parts.
Asate AG holds the therapy seminars on principle at the dates and places announced.
If Asate AG is not able to hold specific seminars for organisational or other reasons, Asate AG reserves the right to cancel the event and will submit new suggested dates to the participants.
If a participant is not able or not willing to take part in a substitute therapy seminar offered in such a case, any costs already paid are reimbursed.
If the participant is not able to take part in a scheduled therapy seminar due to the participant’s own fault, for reasons attributable to the participant or due to force majeure, his/her credit balance is retained for 12 months so that Asate AG can offer an appropriate substitute seminar to the participant. Subsequently, the credit balance is forfeited in favour of Asate AG. Costs already paid are not reimbursed.
Registration is only possible using the specific registration form or using the online form via the website of Asate AG.
The registration is deemed to be binding and is valid for one person.
By signing the registration form, the participant accepts the General Terms and Conditions of Asate AG.
After receipt of the registration, the participant will receive an invoice including participation confirmation.
If the registration is made via the website, the participant may chose to pay for the therapy seminar via PayPal or by invoice.
Participation in the therapy seminar is only possible after prepayment.
After receipt of the payment, the therapy place is reserved definitively.
If the participant has attended both seminar parts, Asate AG will automatically send a login code.
This login code offers the option of using all additional offerings of Asate AG for an unlimited time.
Exclusion of Liability
Asate AG does not make any medical diagnoses. Attending therapy seminars does not replace consulting a medical doctor or any other necessary medical examination of the seminar participant.
The participants of Asate standard seminars are obliged, under their own responsibility, to determine and to review whether information they receive is complete, correct and suitable for their purposes.
The Asate AG seminar visits are at the participant’s own risk.
Asate AG assumes no liability of whatsoever type for the success of knowledge or methods communicated by it.
Asate AG offers potential participants the opportunity of registering for the online therapy seminar selected by them, hereinafter referred to as “online seminar”.
Online therapy seminars are divided into 3 parts each of 2 hours, which can be selected freely by the participant upon registration.
Asate AG holds the online seminars on principle at the dates announced.
If Asate AG is not able to hold specific seminars for organisational, technical or other reasons, Asate AG reserves the right to cancel the event and will submit new suggested dates to the participants.
If a participant is not able or not willing to take part in a substitute online seminar offered in such a case, any costs already paid are reimbursed.
If the participant is not able to take part in a scheduled online seminar due to the participant’s own fault, for reasons attributable to the participant or due to force majeure, his/her credit balance is retained for 12 months so that Asate AG can offer an appropriate substitute seminar to the participant. After receipt of the payment, the participant will receive a login code by email, which is to be used for participating in the online seminar booked by the participant.
After full completion of the online seminar, the participant has the option of using all additional offerings of Asate AG for an unlimited time.
The participant is responsible for creating the technical prerequisites in order to participate in an online seminar.
Asate AG publishes the necessary technical prerequisites on the website.
Asate AG undertakes to design the software in such a way that it is compatible to the most commonly used programmes.
Asate AG assumes no responsibility if participation in an online seminar is not possible due to technical problems that are attributable to the participant or due to force majeure.
Asate AG offers snorers the possibility of ordering a plexiglass instrument with playing instructions.
An order can be placed via the Asate website, by email, phone, fax or the Asate order form and is regarded as a purchase contract.
These General Terms and Conditions apply to all order transactions listed under clause 5.1.2.
The price for self-training is inclusive of the therapy instrument, value added tax, postage, customs duties (foreign countries) and packaging.
Together with the delivery note, the purchaser receives a login code from Asate AG.
Delivery of the instrument and release of the login code will be effected as soon as possible after the receipt of payment.
The login code offers the option of using all additional offerings of Asate AG for an unlimited time.
Right of Return and Waiver of Liability!
As a rule, no right of return exists for a plexiglass didgeridoo with playing instructions purchased from Asate AG.
In the event of verifiable production defects, Asate AG undertakes to replace the therapy instrument at no cost. Asate AG is to be notified of such defects in writing within 10 days from the receipt of the therapy instrument.
Self-training does not replace any necessary medical examination of the trainee.
The Asate self-training participants are obliged, under their own responsibility, to determine and to review whether information they receive is complete, correct and suitable for their purposes.
Self-training is performed at each person’s own risk.
Asate AG assumes no liability of whatsoever type for the success of the method described in the playing instructions.
VI. Additional Offerings
The additional offerings provided by Asate AG can only be used after successful completion of a standard or an online seminar or after delivery of the plexiglass instrument including playing instructions.
The General Terms and Conditions of Asate AG shall apply to all additional offerings.
The prepayment as defined in these General Terms and Conditions applies to all additional offerings.
VII. Legal Notes
1. Notes for the User
The web pages under the asate.ch portal are intended exclusively as general information about the fields of snoring and sleep apnoea and do not claim to be correct and complete.
Research and clinical experience in science and medicine are continuously expanding our knowledge. This also applies, in particular, to the treatment of snoring and sleep apnoea. Accordingly, the visitors of asate.ch are obliged, under their own responsibility, to determine and to review whether information provided on these pages is complete, correct and suitable for their purposes.
Where the internet pages of Asate AG refer to a therapy, a treatment method or an application, the reader can be confident that the authors have used the maximum care and diligence for their work. However, neither Asate AG nor the authors can assume any warranty for the information about therapies, treatment methods or applications. Relevant information or notes are explicitly not regarded as a recommendation.

2. Exclusion of Liability

The authors explicitly reserve the right to modify, supplement or delete parts of the pages or the entire online content without separate announcement or to suspend publication temporarily or finally.

4. Data Protection
If it is possible to input personal or business data (email addresses, names, addresses, etc.) on the internet pages, the input of this data by the user is effected on an explicitly voluntary basis.
